Prime Minister Ilie Bolojan asks all the ministers in his office to publish his statements of wealth and interests, a press release of the Government of Romania shows, sent on Friday night. Bolojan motivates the action “in the context of the Government's commitment for transparency and integrity, assumed since the moment of the Parliament.”

“The Prime Minister of Romania Ilie Bolojan asked all the ministers to send to the Prime Minister's Chancellery the declarations of wealth and interests submitted after appointment, together with the agreement for publishing them on the website of the Romanian Government.

Also, the prime minister appeals to the members of the cabinet to publish these documents and on the official pages of the ministries they lead and to encourage the application of the same measure and in the case of other persons with public dignity functions ”, the Government reports in the press release.

Although the Constitutional Court has decided, in May, that the article of law is unconstitutional that provides for the obligation to publish the statements on the website of the National Integrity Agency, Ilie Bolojan transmits that “the existence of a moral and political obligation prevails in the exercise of a public function”.

“Transparency in the exercise of public function is not only a legal obligation, but a principle underlying the functioning of this government. The voluntary publication of declarations of wealth and interests is a gesture of responsibility before the citizens and a proof of respect for democratic values,” the statement said.

Statements of wealth and interests should not include the goods and revenue of the spouses, the CCR decided

The Constitutional Court decided on May 29 that statements of wealth and interests should not include the goods and revenues of the spouses. As a result of this decision, which is final, the declarations of wealth that are submitted to the National Integrity Agency no longer have to include the goods of the spouses and children.

Specifically, the Constitutional Court declared unconstitutional article 3 paragraph (2) of Law no. 176/2010, which stipulates: “The declarations of wealth are drawn up on their own responsibility and include the rights and obligations of the declarant, of the spouse, as well as of the children in maintenance, according to Annex no. 1”.

Also, the constitutional judges declared unconstitutional the article of law which provides for the obligation to publish the statements on the website of the National Integrity Agency.

This article provides: “The Agency ensures the display of declarations of wealth and the statements of interests, provided in annexes no. 1 and 2, on the website of the Agency, within a maximum of 30 days from the reception, by anonymizing the address of the declared buildings, except for the locality where they are, of the address of the institution that manages the financial assets, of the Personal Code, as well as of the Personal Code. Interests are kept on the website of the Agency throughout the exercise of the position or mandate and 3 years after its termination and is archived according to the law ”.
