On Friday, MPs agreed to detain the former Minister of Justice, the Prosecutor General Prosecutor of Zbigniew Ziobro and forced bringing him to the meeting of the PEGASUS Inquiry Commission. Ziobro did not appear eight times on the interrogation within the prescribed period.

241 deputies were in favor of a request to agree and bring Ziobra to the meeting of the Pegasus committee, 197 was against it; Nobody abstained. Most of them were 231 deputies.

On June 27, Zbigniew Ziobro did not appear for the eighth time at the audition before the Sejm Investigative Commission for Pegasus. Its members then decided to start a procedure aimed at stopping and bringing it to its meeting.

On July 11, the then prosecutor general, the head of MS Adam Bodnar announced that he had submitted to the Marshal of the Sejm a request for consent to the arrest and forced bringing of Ziobra to the meeting of the investigation commission. “For” was also the Sejm Regulations committee, which gathered on this matter on Wednesday. During her meeting, the chairwoman of the Pegasus Investigation Committee Magdalena Sroka (PSL-TD) assessed, among others, that Ziobra's repeated evasion from appearing on the interrogation “bears all features of persistent obstruction of the conduct and this is a conscious action, aimed at preventing the committee of performing its constitutional duties.”

In turn, Ziobro argued at the time that the Pegasus committee was illegal and emphasized that “no lawless should not be succeeded.” He also referred to the events of the end of January this year, when he was arrested to bring him before the committee, and then – as he said – “he was prevented from leaving the room.” “This is an obvious criminal crime for which you will be responsible in the future,” Ziobro said, turning to Sroka.

The former Minister of Justice, like other PiS politicians, believes that the Sejm inquiry commission is illegally operating. This view is based on the judgment of the Constitutional Tribunal of September 2024, which ruled that the resolution of the Sejm on the establishment of this committee was unconstitutional.

Over a year ago, however, the Sejm adopted a resolution, in which he stated that “in the activities of the public authority of the CT public authority issued in violation of law may be considered a violation of the principle of legalism by these authorities.” Since the Sejm adopted that resolution, the judgments of the Constitutional Tribunal are not published in the Journal of Laws.

The Pegasus inquiry commission is investigating whether the use of this surveillance software by the government, special services and the police at the time PiS ruled was lawful. The Commission is also to determine who was responsible for the purchase of Pegasus and similar tools for Polish authorities. (PAP)
