Higher penalties for the lack of liability and PCC-3 in 2026.

Along with the minimum salary, which from January 2026 will amount to PLN 4806 gross in Poland, the dimensions of penalties and fines will also increase. More will have to be paid, among others for the lack of a purchased liability insurance policy and a submitted PCC-3 declaration when buying a used car. According to the Regulation of the Council of Ministers published on Monday, In 2026, the minimum gross wage in Poland will amount to PLN 4806 and the hourly rate of PLN 31.40.

Which will please the least paid, will sadden or mobilize late dormitory drivers, who sometimes forget to extend the validity of the liability insurance policy. The penalty for its lack is dependent on the amount of the minimum wage.

And yes Failure to buy a mandatory liability insurance policy will be able to bind a penalty of up to PLN 9,612. So much from January 2026 will be paid by owners of passenger cars, which will not have a liability insurance policy for more than 14 days. And regardless of whether the car will be used or will be only in the parking lot.

Currently, the maximum law provided for by law is PLN 9,332. For comparison, in 2024 it was PLN 8,600, in 2023 PLN 6,980, in 2022 PLN 6020 in 2021 PLN 5,600.

The amount of minimum gross wage (PLN 4806 in 2026) will be paid by owners of passenger cars, for which the liability insurance policy will be invalid from 4 to 14 days. If the policy expired a maximum of three days earlier, the penalty will be 40 percent. minimum gross wage, i.e. from January 1, 2026, PLN 1922.

Truck owners, tractors and buses are threatened with higher penalties. Lack of policy for longer than 14 days in their case will be able to end with a penalty of PLN 14,418, from 4 to 14 days – PLN 7209 and up to three days PLN 2884.

Much higher penalties threaten to owners of cars, who will not submit a PCC-3 declaration in a timely manner, on the basis of which the tax office calculates the tax (2 percent) on civil law transactions-e.g. for the used used car. The deadline for submitting a declaration is 14 days from the conclusion of the contract.

In this case Penalties from January 2026 will be in the range of PLN 481 (10 % of the minimum wage) to PLN 96 120 (twenty times the minimum wage).

We would like to remind you that from 10 September, when buying a used car, the buyer may indicate the date of termination of the civil liability contract in advance, which was concluded by the previous vehicle owner. This is a significant change because, according to the still binding regulations, the termination of the existing contract means that the next day it ceases to apply, which – in the absence of a new policy – can be exposed to a lack of continuity and high penalties.
