35 days of vacation in 2025, who is entitled to and how to use them?


Employees in Poland can have additional free, even 35 days of vacation. All thanks to the EU directives regarding, among others Work-Life Balance, which was implemented to Polish legislation, amendment to the Labor Code.
In Poland, the employee is entitled to an year:
– 20 days of holiday leave – when the seniority is shorter than 10 years;
– 26 days of holiday leave – When the seniority is at least 10 years.
However, that's not all.
35 days of vacation. How to use them?
Thanks to changes in the Labor Code, you can take up to 35 days of vacation during the year.
– 20 or 26 days of vacation;
– 2 days (or 16 harmonize) for childcare;
– 5 days of care leave;
– 2 days (or 16 hours) of leave due to force majeure.
Until 35 days of vacation, childcare is included
2 days (or 16 harmonize) leave for childcare, a dismissal is entitled to an employee who is raising at least one child up to 14 years of age.
Not only parents, but also people bringing up a child can take advantage of this vacation. The employee retains the right to full remuneration.
35 days of vacation including care leave
5 days of care leave aims to provide care for a family member of an employee (or a person living in the same household), which requires support due to health.
Importantly, the employer may not demand the provision of medical records of the person requiring care. In this case, the employee is not entitled to remuneration.
Vacation due to force majeure
The employee is entitled to dismissal from work due to force majeure for 2 days or 16 hours during the calendar year. The new regulations entered into force in 2023. In the case of this leave, a salary of 50 percent is entitled to remuneration.
It is a solution that can be used in urgent family matters caused, for example, by a close family member, failure or accident if the immediate presence of an employee is necessary. It is assumed that the higher force is an event that is impossible to predict, independent of the will of the employee and one that could not be prevented. We write more in this text.
