Ukrainian Government Updates Mobilization Exemption Rules

The Ukrainian government has officially announced changes to the rules governing mobilization exemptions. Ministries and regional administrations are required to reassess the criteria for critical status and review enterprises that have already received this designation within ten days of the decree coming into effect.
A new Coordination Center for Exemptions will be established, tasked with evaluating requests for granting and revoking critical status for enterprises, as well as increasing exemption limits. This governmental body will have up to seven working days for the initial review of documents, while the Coordination Center will take up to one calendar month to issue recommendations. A final decision will then be made within three working days.
If an enterprise’s limit has been increased but it fails to reserve employees through the Diia platform within ten days, the increase will become void. The limits will also take into account the needs of large families and guardians.
For selected enterprises in the defense and energy sectors, a limit of 95% will apply, with mandatory reservation for employees directly involved in production. Increases beyond 95% can be approved by a separate decision.
Violations of military registration rules may affect exemption status. If a company’s management has consistently breached military registration rules, it may serve as grounds for denying a request to increase the exemption limit. Additionally, the Coordination Center can recommend the revocation of critical status, particularly following requests from law enforcement agencies.
